Terms and Conditions – Smarteducators

These Terms and Conditions (“Terms”) govern your use of the Smarteducators website and recruitment platform (“we”, “our”, “us”). By accessing or using our services, you agree to comply with these Terms. If you do not agree, please do not use the platform.
1. Definitions
“Candidate” refers to any individual who registers on the platform to apply for jobs, upload a CV, or create a profile.
“Employer” refers to any individual, organisation, or entity posting jobs or seeking candidates via the platform.
“User” refers to both candidates and employers collectively.
“Services” refers to the recruitment, training, consulting, and other related services provided by Smarteducators.
2. Eligibility
You must be at least 18 years old to register as a candidate or employer.
Employers must be authorised representatives of their organisation.
You are responsible for ensuring that all information you provide is accurate, current, and complete.
3. User Accounts
You are responsible for maintaining the confidentiality of your account login details.
You agree to notify us immediately if you suspect unauthorised use of your account.
We reserve the right to suspend or terminate accounts that violate these Terms or applicable laws.
4. Candidate Responsibilities
Candidates must:
Provide truthful, accurate, and complete information in their profiles and CVs.
Apply only to jobs for which they are qualified or interested.
Avoid sending unsolicited or irrelevant information to employers.
5. Employer Responsibilities
Employers must:
Provide accurate job descriptions, requirements, and contact details.
Avoid posting any discriminatory, offensive, misleading, or unlawful job content.
Comply with all applicable labour laws and regulations when hiring.
Treat candidate information as confidential and use it solely for recruitment purposes.
6. Prohibited Conduct
You may not:
Use the platform for any unlawful purpose.
Post or share false, misleading, or fraudulent information.
Harass, abuse, or exploit other users.
Attempt to gain unauthorised access to the platform or its systems.
7. Content Ownership and Licence
Users retain ownership of the content they submit, such as CVs, profiles, and job listings.
By submitting content, you grant Smarteducators a non-exclusive licence to store, display, and share it with relevant parties in connection with our Services.
8. Privacy and Data Protection
We process personal information in accordance with our Privacy Policy and POPIA requirements. By using our platform, you consent to such processing.
9. Service Availability
We aim to keep the platform available at all times but do not guarantee uninterrupted access. We may temporarily suspend the service for maintenance or updates.
10. Limitation of Liability
We act as an intermediary between candidates and employers and are not responsible for the hiring decisions, actions, or conduct of either party.
We do not guarantee the accuracy, completeness, or suitability of any job listing or candidate profile.
To the fullest extent permitted by law, we are not liable for any direct, indirect, or consequential damages arising from your use of the platform.
11. Indemnity
You agree to indemnify and hold harmless Smarteducators, its directors, employees, and partners from any claims, damages, or expenses arising from your use of the platform or breach of these Terms.
12. Changes to the Terms
We may update these Terms from time to time. Continued use of the platform after changes are published constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of South Africa. Any disputes will be subject to the exclusive jurisdiction of the South African courts.
